Terms of Service

Please read these terms carefully before using TalkToWP.

1. Introduction

Welcome to TalkToWP ("Service"), a product operated by Beyondt Consultancy & Services Pvt. Ltd. ("Company", "we", "us", or "our"), registered under the laws of India at 302, EE 194, Sector 2, Saltlake, Kolkata 700091, West Bengal, India. By accessing or using our Service, you agree to be bound by these Terms of Service ("Terms").

2. Description of Service

  • Automated website health checks every 3 minutes, 24/7
  • Security vulnerability and plugin conflict detection
  • Performance tracking via Google PageSpeed Insights
  • AI-powered issue explanations and remediation guidance
  • Plugin and theme update notifications
  • Incident detection, logging, and alerting
  • Email alert delivery
Monitoring, not guarantee: TalkToWP is a monitoring and alerting tool. We detect and report issues. We do not make changes to your sites and do not guarantee that all issues will be detected.

3. Account Registration

You agree to provide accurate information, maintain account security, keep your password and API keys confidential, accept responsibility for all activities under your account, and notify us immediately of any unauthorised access.

4. Subscription and Payment

4.1 Pricing

  • Solo Plan: $10 USD per month — 1 WordPress site, all features included
  • Agency Plan: $49 USD per month — includes 10 WordPress sites. Additional sites are $5 USD per site per month.

4.2 Billing & Merchant of Record

Payments are processed by Dodo Payments, our Merchant of Record. Your invoice will reflect a charge from Dodo Payments. Terms available at dodopayments.com/terms.

4.3 Free Trial

We offer a 14-day free trial for new accounts. A valid credit card is required. You will not be charged during the trial. At the end of the trial, your selected plan activates automatically unless you cancel beforehand.

4.4 Referral Program

When a referred user completes their first payment, the referring customer earns a one-time account credit equal to 50% of that first payment, capped at $150 USD. Credits are applied automatically to your next invoice, have no cash value, and expire 12 months from issuance.

4.5 Cancellation & Refunds

You may cancel at any time from your account dashboard. Upon cancellation, you retain access until the end of your current billing period. Subscription fees are non-refundable except as required by applicable law.

5. Acceptable Use

You agree not to violate any laws, monitor sites you do not own or have permission to monitor, attempt unauthorised access to our systems, interfere with the Service, reverse-engineer any part of the Service, or resell the Service without written authorisation.

6. Your WordPress Sites

You represent and warrant that you own or have lawful authority to connect and monitor each WordPress site you add. Agency owners connecting client sites under an existing service agreement is explicitly permitted. Our plugin communicates via API keys, not admin passwords.

7. AI-Powered Features

TalkToWP uses OpenAI's API to generate plain-English explanations. AI outputs are informational and should not be treated as definitive technical advice. Anonymised, non-personally-identifiable site data is transmitted to OpenAI. Per OpenAI's API policies, this data is not used to train their models.

8. Intellectual Property

The Service — including its code, design, features, branding, and content — is owned by Beyondt Consultancy & Services Pvt. Ltd. and protected under applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

9. Data and Privacy

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT ALL ISSUES WILL BE DETECTED, OR THAT ALERTS WILL BE DELIVERED WITHOUT DELAY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEYONDT CONSULTANCY & SERVICES PVT. LTD. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Beyondt Consultancy & Services Pvt. Ltd. from any claims, liabilities, damages, losses, costs, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account immediately if you breach these Terms or engage in fraudulent activity. You may close your account by contacting support@talktowp.com.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of the courts of Kolkata, West Bengal, India (Calcutta High Court). Consumers in the EEA or UK retain rights under mandatory local consumer protection laws.

15. Changes to These Terms

We may modify these Terms at any time with reasonable notice. Continued use of the Service after changes take effect constitutes acceptance.
